The Truth About Tort Reform Print E-mail

You have heard and read about “tort reform” legislation. Most of the information you have heard and read is false. The tort reform legislation recently passed by the Texas Legislature includes a vote on a constitutional amendment. It would grant the power to our Legislature to place limits on ANY AND ALL types of cases, not just those against doctors and hospitals. The legislation was sold to the public as a stop-gap measure to assist doctors and hospitals. If the constitutional amendment passes, the Texas Legislature will have the power to place limits on all types of cases without requiring an approval from voters. In other words, the insurance lobbyists and the ill-informed legislators will take the place of twelve jurors. The insurance lobbyists and their representatives used the medical malpractice issue to “backdoor” the public. Voters beware.

This legislation was also sold to the public as a means of reducing insurance premiums. Let me assure you there is absolutely no provision in the law to reduce, control or rollback ANY insurance premiums. There will be no reduction in liability premiums, homeowners premiums, automobile premiums or the like. This type of tort reform harms every citizen and only helps the insurance industry. We encourage each of you to vote against the September 13th constitutional amendment.
